This text shall be governed by and construed in accordance with the laws of Germany. The English version of this text serves only as information and is not part of this legal transaction. Therefore, in the event of any inconsistency between the German and the English version, only the German version shall apply.

  1. EBRO IMMOBILIEN GmbH’s offers are non-binding and subject to change. We reserve the right to errors, interim sale or rental. All property-related information is based on the details and information provided by the vendor. EBRO IMMOBILIEN GmbH does not assume liability for the correctness and completeness of these details. It lies with the client to check the accuracy of all data.

  2. The commission stated in each individual offer shall be required to be paid on conclusion of the contract.

  3. Our commission will be due as soon as the contract is concluded for the property we have brokered. The contracting party agrees to inform EBRO IMMOBILIEN GmbH immediately when, and under which terms, there is an agreement with regards to a property offered by EBRO IMMOBILIEN GmbH. If the agreement is concluded under different terms to those originally offered, or is for a different property with the same vendor, this shall not affect our claim for commission insofar as the transaction which takes place is economically identical to the transaction offered by us.

  4. The recipient undertakes to inform us immediately should he/she receive an offer or listing regarding a property of which he/she already knows about.

  5. EBRO IMMOBILIEN GmbH’s listings and documents are intended solely for the recipient. These may not be made accessible or forwarded to a third party without our express prior written consent. The recipient is required to pay the full commission agreed upon should he/she violate this obligation which, as a consequence, results in the third party concluding the contract. As a result of this disclosure to a third party, full commission will be due on conclusion of the main contract.

  6. We are entitled to provide comission-based services to the other contract party.

  7. EBRO IMMOBILIEN GmbH shall only be liable in the case of wilful intent and gross negligence. Excluded from this limitation of liability are damages from injury to life, limb or health.

  8. The place of performance and jurisdiction – if the client is a ‘Vollkaufmann’ as meant by the German Commercial Code – is Munich. German law shall be applicable.

  9. The entire contents of this expose, including all graphics and images, are the property of EBRO IMMOBILIEN GmbH and may neither be used by, nor forwarded to, a third party.

  10. If one or more provisions of our Terms and Conditions should be or become ineffective, this shall not affect the efficacy of the remaining provisions. The invalid clause shall be replaced by a clause which comes closest in terms of economic sense to the original clause.
